The Nile: The Principle of Equitable and Reasonable Use and the Obligation to Prevent Significant Harm

Understanding Equity, National Needs, and Shared Responsibility within the Transboundary Nile System

By Anthony Kon

This article draws on themes examined in The Nile Basin: History, Diplomacy, and the Quest for Equitable Cooperation, by Anthony Kon, published by Sarkon Plus Publishing.

Clarification

I am not a legal specialist, and this article is not intended to provide legal advice or an authoritative legal interpretation. Rather, it seeks to explain selected principles of international water law in clear and accessible language within the context of the issues examined in the book. When determining legal rights and obligations or formulating official positions, States and other concerned parties should consult the official texts of the relevant United Nations conventions and other applicable legal instruments and seek advice from qualified legal experts. In the event of any inconsistency, the official legal texts and their authoritative interpretations should prevail.

The concept of equity frequently appears in discussions concerning the Nile Basin, yet its practical meaning is not always explained with sufficient clarity. Governments speak of equitable rights, fair water allocation, historical uses, development needs, water security, and the obligation not to cause significant harm. Although all these considerations are important, their application does not necessarily lead to the same conclusion. Each Nile Basin country approaches the Nile in light of its particular geographical, historical, economic, and political circumstances.

For some countries, the Nile is associated with longstanding dependence, water security, and the fulfilment of vital needs. For others, it represents a resource offering development opportunities that have not yet been fully realized. Understanding the principle of equitable and reasonable use therefore involves more than choosing between competing national claims. It requires examining how international water law seeks to balance the legitimate interests of riparian States within the shared transboundary Nile system.
